Under the Protection of Personal Information Act
The purpose of this Privacy Policy is to set out how, why, and when SECOND RODEO (PTY) LTD (“SR”) obtain, use, and disclose your Personal Information in terms of the Protection of Personal Information Act 4 of 2013 (“POPIA”). In this Privacy Policy:
- “Personal Information” bears the same meaning as set out in POPIA, which includes information in respect of, but not limited to: the biometric information of the person; any identifying number, symbol, e-mail address, telephone number, location information, online identifier or other particular assignment to the person; information relating to the race, gender, sex, pregnancy, marital status of the person; information relating to the education or the medical, financial, criminal or employment history of the person.
- “Special Personal Information” bears the same meaning as set out in Section 26 of POPIA, which includes personal information in respect of, but not limited to: religious or philosophical beliefs, race or ethnic origin, trade union membership, political persuasion, health or sex life.
- “Process/Processing” bears the meaning as set out in POPIA, which includes, but not limited to: the collection, receipt, recording, organisation, collation, storage, updating or modification, retrieval, alteration, consultation or use of Personal Information.
1. Personal information
1.1. SR processes your Personal Information in a manner that is reasonable, lawful, adequate, relevant and non-excessive.
1.2. When you register through our online portal and/or website and/or use same, SR is required to collect certain personal information that is obtained both directly and indirectly from you in order to register your account on the website and/or allow you to have access to content and all related and/or associated features and platforms relating to same.
1.3. Website usage information may be collected using “cookies” which allows us to collect standard internet visitor usage information.
1.4. Such information may include:
• Publicly Available Personal Information: We collect first name, maiden name, last name, nickname, phone numbers, business email, business phone number, current and former address, and other similar data.
• Personal Information Provided by You: We may collect purchase history, and other similar data.
• Credentials: We collect passwords, password hints, and similar security information used for authentication and account access.
• Payment Data: We collect data necessary to process your payment if you make purchases, such as your payment instrument number (such as a credit card number), and the security code associated with your payment instrument.
• All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.
• Information automatically collected: We automatically collect certain information when you visit, use, or navigate the website, which may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our website and other technical information. This information is primarily needed to maintain the security and operation of our website, and for our internal analytics and reporting purposes.
• Online Identifiers: We collect devices, tools, and protocols, such as IP (Internet Protocol) addresses, cookie identifiers, or others such as the ones used for analytics and marketing, device’s geolocation, and other similar data.
1.5. SR will only collect and use your personal information only for the purpose for which it was collect and in order to enable it to sell and deliver the goods sold by it to you and/or to offer you services and/or to allow you access to its platforms.
1.6. When opening your account and/or making use of the online portal, we may collect Personal Information in respect of, but not limited to:-
1.6.1. Your full name;
1.6.2. Your identity number and/or passport number;
1.6.3. Your e-mail address;
1.6.4. Your contact numbers;
1.6.5. Your place of residence;
1.6.6. Your Income Tax Number.
1.7. SR processes your Personal Information to:
1.7.1. identify you and verify your identity;
1.7.2. facilitate account creation and logon processes;
1.7.3. send you marketing and promotional communications;
1.7.4. send administrative information to you;
1.7.5. fulfil and manage your orders;
1.7.6. manage user accounts;
1.7.7. deliver services to the user;
1.7.8. fulfil contractual necessities;
1.7.9. respond to user inquiries/offer support to users;
1.7.10. for other Business Purposes; and
1.7.11. comply with any legal or regulatory obligations.
2. Retention of information
2.1. During the business relationship with you, SR will retain your Personal
Information for as long as:
2.1.1. SR continues to render services to you; or
2.1.2. retention is required or authorised by law;
2.2. When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then SR undertakes to ensure that all reasonable and necessary steps are taken to ensure that your Personal Information is stored securely.
3. Disclosure of information
3.1. We may disclose your personal information to our service providers who are involved in the delivery of products or services to you. We have agreements in place to ensure that they comply with the privacy requirements as required by the Protection of Personal Information Act.
3.2. Your Personal Information may also be processed by:
3.2.1. employees of SR;
3.2.2. law enforcement officials and/or third parties where the disclosure of the Personal Information is necessary or appropriate in connection with an investigation of criminal activities or any other activity that is illegal or may expose SR to legal liability or financial loss.
4. 3.3. If SR processes your Special Personal Information, SR undertakes to get your consent in order to carry out such processing.
4. Protection of your personal information
4.1. SR hereby undertakes to secure the integrity and confidentiality of your Personal Information in its possession or under its control by taking appropriate, reasonable technical and organisational measures to prevent loss of, damage to or unauthorised destruction of your Personal Information; and unlawful access to or processing of your Personal Information.
4.2. In order to implement such measures, SR has identified all reasonably foreseeable internal and external risks to your Personal Information in SR’s possession or under SR’s control; and has established and maintained appropriate safeguards against the risks identified such as:
4.2.1. Secure storage and destruction of your records of Personal Information;
and
4.2.2. Personal Information breach reporting and remediation.
4.3. Where there are reasonable grounds to believe that your Personal Information has been accessed or acquired by any unauthorised person, SR undertakes to notify you, in writing, as soon as reasonably possible after the discovery of the compromise.
4.4. In the event that SR, in its course and scope of rendering professional services to you, makes use of third parties, who will have access to your Personal Information, SR will ensure that such third party enters into a confidentiality agreement, and takes the same steps that SR does, as a minimum, to safeguard your Personal Information.
5. Data security
5.1. We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. However, please also remember that we cannot guarantee that the internet itself is 100% secure. Although we will do our best to protect your personal information, transmission of personal information to and from our services is at your own risk. You should only access the services within a secure environment.
6. Your rights in respect of your personal information
6.1. You have the right to view, correct and/or amend your Personal Information that SR processes and retains.
6.2. You have a right to request a copy or the description of your Personal Information that SR has in its possession.
6.3. You have a right to request to have your Personal Information corrected, destroyed, or deleted.
6.4. To exercise any of the abovementioned rights, you are required to send an email to SR’s Information Officer, Mr M. Stopforth, at hello@secondrodeo.co.za and SR will take all reasonable steps to confirm your identity before providing details of your Personal Information.
6.5. Please note that any such access request may be subject to a payment of a legally allowable fee.
6.6. SR undertakes to notify you of the action taken by SR because of your request, and where such request is not granted, SR undertakes to inform you of the reasons for refusal.
6.7. You also have a right to object to the processing of your Personal Information; or withdraw your consent to processing.
7. Cookies and how we use the information
7.1. Please be aware that SR uses Cookies on the website.
7.2. Cookies may be described as text files containing a small amount of information that are downloaded to your device when you visit a website.
7.3. Cookies are utilised by SR to gather information so that SR can ensure that the website provides the best user experience to you.
8. Marketing
8.1. SR may from time to time send marketing e-mails or messages to the e-mail address, or cell phone number provided by you when utilising the website.
